Terms and Conditions of Hire

By booking with RM Party Wonderland, you agree to these Terms.

Here are the main points:

Booking fee: A $200 booking fee (per booth) secures your date (unless booking within 14 days). Your date isn’t confirmed until received.

Final payment: Balance is due 7 days before your event and must be paid no later than 48 hours before the event start time.

Grace period: If you book more than 45 days out, you have a 7-day grace period to cancel for a full refund of the booking fee. After that, it’s non-refundable.

Last-minute bookings: Within 14 days, full payment is required at booking.

Cancellations: Cancellation charges are limited to amounts already paid (we don’t chase unpaid balances).

  • >45 days: booking fee only​

  • 15–45 days: up to 50% of hire fee (capped at amount paid)

  • ≤14 days: up to 100% of hire fee (capped at amount paid)

If we cancel / don’t attend: You receive a 100% refund of all payments made.

Venue requirements: You must ensure access, power, and approvals are in place. Venue delays/access/power issues may reduce service time and don’t automatically extend the booking.

Equipment faults: If our equipment is down for more than 30 minutes due to our fault, you’ll receive a pro-rata refund for the affected time.

Outdoor/WHS: Outdoor setups require weather protection. If conditions are unsafe and can’t be resolved, we may stop service and amounts paid are retained (subject to ACL).

Instant prints: Each guest in each photo receives their own printout.

Sharing & gallery: Instant sharing depends on Venue Wi-Fi/mobile reception. Gallery link is sent next business day and is available for 3 months - please download promptly.

Full Terms & Conditions

1) Definitions

Provider: RM Party Wonderland
Client: the person/business booking our services


These Terms are the entire agreement and replace all prior discussions/documents.

2) Booking Fee & Payment

  • A $200 booking fee (per booth) secures your date (unless clause 4 applies). Your date is not confirmed until received.

  • The balance is due 7 days before the event and must be paid no later than 48 hours before the event start time shown on the booking/invoice.

  • If full payment is not received by then, the booking is treated as cancelled by the Client and the booking fee is forfeited.

3) Booking Fee Grace Period

  • Bookings made more than 45 days out: the Client may cancel within 7 days of paying the booking fee for a full refund. After that, the booking fee is non-refundable.

  • Bookings within 45 days of the event: the booking fee is non-refundable immediately.

The booking fee is a genuine pre-estimate of our costs and losses in reserving the date (including admin, design/prep and turning away other jobs).

4) Last-Minute Bookings

If booked within 14 days of the event date, full payment is required at booking and no booking fee (deposit) applies.

5) Date Changes

Date change requests must be made in writing at least 21 days before the original event date and are subject to availability. If approved, payments transfer to the new date and any price difference/additional costs (e.g. travel) may apply. If we can’t accommodate the new date, it is treated as a cancellation (clause 6).

6) Client Cancellations

Cancellations must be made in writing. The booking fee is non-refundable (except the grace period in clause 3).

 

Cancellation charges are limited to amounts already paid; we do not invoice or pursue unpaid balances.

From payments already received, we retain:

  • Client cancels more than 45 days before event: booking fee only; any additional payments are refunded.

  • 15–45 days before event: up to 50% of the total hire fee, capped at the amount already paid.

  • 14 days or less before event: up to 100% of the total hire fee, capped at the amount already paid.

7) Provider Cancellation / Non-Appearance

If RM Party Wonderland cancels or does not attend, the Client receives a 100% refund of all payments made. This does not apply where the Client has failed to pay amounts due by the required time.

8) Additional Time

Additional time is charged at the applicable hourly rate in 30-minute increments, must be approved, and must be paid before it is provided.

9) Venue Delays, Access & Requirements

The Client is responsible for venue access, permissions and requirements (including approvals, inductions, bump-in/out times, power supply, loading/parking and any venue fees). If the venue requires documents (e.g. insurance certificate, test-and-tag), the Client must notify us in advance and provide the correct venue contacts/processes.

Venue delays, poor access, lack of power supply, or other issues outside our control do not entitle the Client to a refund. Delays caused by the Client/venue may reduce service time and do not automatically extend the booking, however we may extend at no additional charge if allowed by our schedule (but this is no guarantee). If we cannot set up or operate due to missing permissions, access or requirements, this is treated as a venue/client issue and all amounts paid are retained (to the extent permitted by law, subject to ACL).

10) Service Level & Late Starts

 

If a fault with our equipment prevents the booth from operating, we’ll fix it as quickly as possible. If the booth cannot operate for more than 30 minutes due to our fault, you’ll receive a pro-rata refund of the hire (service) fee (excluding travel, accommodation and optional add-ons already provided/committed) for the affected time.

“Cannot operate” means the booth is unable to capture and produce the booked output (photos, videos and/or prints) for guest use. It does not include delays in sharing caused by venue internet/mobile reception or third-party systems, or downtime caused by Client/venue delays or standby requests.

If the start time is delayed by the Client/venue, service still ends at the scheduled end time unless extra time is purchased. If our schedule allows, we may extend at no charge and usually do when we can, but this is not guaranteed.

11) Substitution

If any equipment/feature becomes unavailable due to fault, damage, supplier issues, or other reasons outside our reasonable control, we may provide a comparable substitute to deliver the service as close as reasonably possible. A substitute is not a failure to provide the service and does not entitle the Client to cancel/refund solely due to the difference. If we cannot provide any working booth/service, the Client receives a full refund of amounts paid (subject to ACL).

12) WHS, Outdoor Use & Conduct

The Client must provide a clean, flat, dry area (3m x 3m), a standard power outlet within 10m, confirm the agreed setup time with the venue, and provide one chair for attendants.

Outdoor use requires adequate protection from sun, rain and wind (where a backdrop is used) for setup to pack-down.

 

If conditions are not fit for the photo booth service, or if something unexpected happens, we will work with the client and venue first to find a practical solution.

 

If conditions are still unsafe/unsuitable and there is no solution to eliminate these risks, we may refuse to operate or terminate service; in that case all amounts paid are retained by RM Party Wonderland (to the extent permitted by law, subject to ACL).

We may also pause/stop service or exclude any person who is dangerous, abusive, aggressive, or grossly intoxicated.

13) Props

Props must stay in the booth area and be used only for the booth. We may remove/withhold props if misused or taken. Children under 10 must be supervised by an adult.

We do encourage active participation by event organisers together with the attendant to make sure props are returned to the props table.

Significant loss/damage may be charged at replacement cost.

14) Instant Prints + Postcard Surcharge

Number of prints is limited to the number of guests pictured, and we may limit/pause printing for misuse, bulk reprints, or where continued printing risks running out of supplies, disrupting service, and creating queues.

Additional reprints may be available at the attendant’s discretion.

Also, if the Client selects a Postcard (4 inches x 6 inches) instead of strips (2 inches x 6 inches), a surcharge may apply based on the size of the event as Postcards use double the amount of paper and ink.

15) Sharing & Internet Reception

When the guests actually receive their download links to their phones depends on venue Wi-Fi/mobile reception and third-party systems. Instant delivery is not a certainty and we aren’t responsible for delays outside our control (including guest phone settings, carrier blocks or spam filters). If internet reception is poor at the event, files will be delivered to guests' phones by the next business day once the booth is returned to a stable internet location.

16) Minimum Output

We do not guarantee a minimum number of photos/videos; output depends on guest participation, booth placement, queueing and venue conditions.

17) Online Media Gallery

Gallery link is sent the next business day after the event (unless otherwise advised). Gallery access is provided for 3 months. Download promptly; as availability beyond that period is not a given and we aren’t liable for loss of files after it.

18) Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control (including fire, terrorism, natural disasters, extreme weather, flooding, cyclones, earthquakes, labour disturbance or war) that prevent attendance or safe operation.

If a force majeure event prevents the service, we will offer a reschedule (subject to availability) or a credit valid for 6 months. If rescheduling isn’t possible, we will refund amounts paid minus reasonable, non-recoverable costs already incurred such as labour hire costs, design, admin, travel and customisations (subject to ACL).

19) Damage to Equipment

The Client is responsible for loss/damage caused by the Client, venue, guests or others at the event (including misuse/negligence). If service cannot be completed due to such damage, the Client is liable for damage costs and service fees paid are non-refundable. We may invoice repair/replacement costs with supporting evidence (photos/quotes); payment due within 14 days.

The Client must also ensure guests keep drinks, confetti/glitter and smoke/fog effects away from the booth and equipment.

20) Indemnity & Liability

The Client indemnifies RM Party Wonderland for claims, liability, loss or damage connected with the event and use of the booth/photos/videos, except to the extent caused by our negligence.

21) Photo/Video Consent

Guests using the booth grant permission for RM Party Wonderland to use photos/videos for lawful business purposes (including promotion). We will not use content featuring minors for marketing/social media, and will remove it promptly if posted in error. If any guests must not be published, the Client must notify us before or during the event.

 

We will seek additional consent for if we recognise any well-known public figures.

22) General

If any clause is unenforceable, the remainder still applies. Changes must be agreed in writing. We both agree to try to resolve disputes in good faith. We are not liable for indirect or consequential loss. Updated Terms apply to future bookings only.

These Terms are governed by the laws of Western Australia.

23) Travel & Accommodation

Travel surcharge applies for events more than 30km from Perth CBD. Travel fee outside 30km is $2/km. If the event is more than 3 hours’ drive from Perth CBD and ends after 11pm, the Client must provide/pay overnight accommodation.

24) Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies rights under the ACL that cannot legally be excluded. To the extent permitted by law, liability for breach of a consumer guarantee is limited (at our option) to resupplying the services or paying the cost of having the services resupplied.
